Welcome to Meniura. By using our services, you agree to be bound by these terms and conditions. Please read them carefully before using the platform.

1. Definitions

  • "Platform": Meniura restaurant and cafe management platform, including the digital menu, point of sale, and ordering services
  • "User": Any person or entity using the platform, whether with a free or paid account
  • "Customer": The end consumer who uses the digital menu to browse the menu or place an order
  • "Services": All services provided through the platform including menu management, orders, point of sale, QR codes, and reports
  • "Subscription": The paid plan chosen by the user to access specific features

2. Acceptance of Terms

By registering on or using the platform, you acknowledge that you:

  • Are at least 18 years of age
  • Have the legal authority to enter into this agreement
  • If representing a company, are authorized to sign on its behalf
  • Will comply with all applicable laws and regulations in the Kingdom of Saudi Arabia

3. Account Creation

  • You must provide accurate, complete, and up-to-date information when registering
  • You are responsible for maintaining the confidentiality of your login credentials and all activities under your account
  • You must notify us immediately of any unauthorized use of your account
  • The chosen company name will be your digital menu URL and cannot be changed later
  • We reserve the right to refuse or suspend any account that violates these terms

4. Subscriptions and Payment

a. Available Plans

We offer multiple plans with different features and limits. Details and pricing of each plan are outlined on the pricing page.

b. Trial Period

We may offer a free trial period for certain plans. Upon expiration, you will be automatically switched to the free plan unless you choose to subscribe to a paid plan.

c. Payment and Renewal

  • Payment is made in advance according to the selected billing cycle (monthly, quarterly, semi-annual, or annual)
  • Subscriptions are automatically renewed unless canceled before the renewal date
  • All prices are in Saudi Riyals (SAR) unless otherwise stated, and include VAT where applicable

d. Refund Policy

You may request a refund within 14 days of subscription if you are not satisfied with the service, provided the platform has not been extensively used during that period. Refunds are processed via the original payment method.

5. Acceptable Use

When using the platform, you must:

  • Use the services only for legitimate business purposes in the food and beverage sector
  • Not upload content that violates laws, regulations, or public decency
  • Not attempt to hack, disrupt, or reverse-engineer platform systems
  • Not use the platform to send spam or unsolicited messages via WhatsApp or any other channel
  • Comply with data protection laws when handling your customers' data
  • Ensure the accuracy of prices, nutritional information, and allergen information displayed on the menu
  • Not resell or sublicense the service to third parties without prior written permission

6. Content and Intellectual Property

a. Your Content

You retain ownership of all content you upload to the platform (menus, images, descriptions, logos). You grant us a non-exclusive license to use this content solely for the purpose of providing the service and displaying it to your customers.

b. Our Property

All intellectual property rights of the platform, including design, source code, interfaces, trademarks, and patents, are exclusively owned by us or our licensors.

7. Service Availability and Performance

  • We strive to ensure 99.5% annual platform availability but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with at least 24 hours prior notice
  • For emergency maintenance, we will make our best effort to notify you as soon as possible
  • We are not responsible for any losses resulting from service interruption due to reasons beyond our control (force majeure)

8. Limitation of Liability

  • The service is provided "as is" and "as available" without express or implied warranties
  • We are not liable for any indirect, consequential, incidental damages, or loss of profits arising from using the platform
  • Our maximum liability does not exceed the value of your subscription during the preceding 12 months
  • We are not responsible for transactions between business owners and their customers

9. Service Termination

  • You may cancel your account at any time from account settings
  • We reserve the right to immediately suspend or terminate your account in case of material breach of these terms
  • Upon termination, you may export your data during the grace period (90 days), after which it will be permanently deleted
  • Sections relating to intellectual property, limitation of liability, and governing law survive termination

10. Force Majeure

We shall not be held liable for any delay or failure in providing the service due to circumstances beyond our reasonable control, including natural disasters, wars, epidemics, internet outages, or government orders.

11. Severability

If any provision of these terms is found to be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.

12. Governing Law and Dispute Resolution

These terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. In the event of any dispute, both parties shall first attempt amicable resolution within 30 days. If amicable settlement fails, the competent courts in the Kingdom of Saudi Arabia shall have jurisdiction.

13. Amendments

We reserve the right to modify these terms at any time. We will notify you of material changes at least 30 days before they take effect via email or a prominent notice on the platform. Your continued use of the platform after the modification constitutes acceptance of the updated terms.
